While Namecheck publishes this website, its content, and information (collectively “the Content”) in good faith, we make no warranty or representation that the Content is complete, correct, or free of errors or omissions.

Limitation of Liability

  • Exclusion of Liability: Namecheck excludes, to the maximum extent permitted by law, any liability that may arise as a result of the use of the Content.
  • Loss: We will not be liable for any indirect, incidental, special, or consequential loss arising from the use of the Content, including but not limited to loss of business profits.
  • Scope: Namecheck’s obligations regarding its services are governed solely by the agreements under which they are provided. Nothing on this website should be construed to alter or form part of such agreements.

Modifications: Namecheck reserves the right to change, amend, or delete the Content from time to time without notice.

4. Service Specifics: Tenant Checks

Sources & Data Retention

Namecheck searches for history provided by Ministry of Justice records and landlord references.

  • Tribunal Orders: Most Tenancy Tribunal decisions are provided, though some are not public due to legal requirements or adjudicator decisions.
  • Historical Data: We store a large volume of published tribunal orders and update new outcomes weekly. Unlike the Ministry of Justice Tenancy Tribunal Orders Online service, we do not remove information after three years. Therefore, our reports may include history older than what is currently published on government sites.
  • References: Landlord and Agent references are included. Accuracy and strict guidelines must be adhered to by those lodging references.

Accuracy of Data

  • Data Integrity: Namecheck makes every reasonable effort to record party names with the highest level of accuracy. However, both the Tribunal and Namecheck rely on the party initiating proceedings to accurately identify the parties involved.
  • Timeliness: Data published on this site is generally accurate to within a week of the decision being published.

5. Data Disputes & Corrections

Nature of Records

Results of tenant name searches are either Orders of the Tribunal (made by Tenancy Adjudicators) or references from former Landlords/Agents.

  • Alterations: We do not alter any information placed on our site. Only the Tribunal can amend an Order through statutory re-hearing or appeal provisions. If an Order is stayed or overturned, the original Order may not be immediately removed due to administrative delays, meaning you may occasionally see both.
  • References: Only the Landlord (or Accommodation Agent) who issued a reference can amend it at their discretion. Namecheck cannot alter these results but may consider breaches of accuracy on a case-by-case basis to highlight issues where possible.

6. Compliance: Credit & Driver’s License Checks

Specific terms apply to regulated checks to ensure compliance with New Zealand law.

Credit Checks

  • Users must agree to terms specific to the use of the Namecheck credit check.
  • In compliance with the Credit Reporting Privacy Code 2020, suppliers and users are subject to random audits.
  • Audit Requirements: You agree to comply with these random regulation investigations. You are required to retain your authorization forms for up to two years from the date of enquiry for audit purposes.

Driver’s License Checks

  • Employers using the Namecheck License check must adhere to specific terms.
  • The New Zealand Transport Agency (NZTA) requires you to use the proper authorization form.
  • Users are subject to random compliance checks or investigations by the NZTA.

7. Pricing, Payment & Refunds

  • Currency: Namecheck is a New Zealand business. All prices are displayed and billed in New Zealand Dollars (NZD).
  • Hidden Costs: There are no additional charges to the basic price.
  • Invoicing: Members purchasing a discounted package will receive an invoice/receipt via email confirming the transaction, which includes our GST number for taxation requirements.
  • Refund Policy: No refund will be given once a check has been run. Please contact us if you require assistance.

8. Service Availability

Namecheck services are available 24 hours a day, 7 days a week, except for unavoidable circumstances such as natural disasters (e.g., flooding, earthquakes) or sudden system failures.

Business Continuity

  • Events such as pandemics do not affect the running of Namecheck; we operate as usual.
  • Holidays: Our administration team closes for all public holidays, Christmas, and New Year.
  • Notifications: We endeavor to send members an email notifying them of annual interruptions (Christmas & Easter) unless the member has unsubscribed from our email list.

9. Intellectual Property & Resources

General forms provided on the website are free for printing and use at any time. These forms include our logo and specific fields referencing the ID used during your checks.

10. Privacy & Cookies

Privacy: Namecheck does not share client details with third parties. For full details, please refer to our Privacy Policy.

Use of Cookies: To ensure we provide relevant content, Namecheck collects site-visitation statistics using cookies.

  • Usage: This information is used in aggregated form solely for improving our site.
