We respect your privacy and uphold your right to see and/or correct your personal information. We do not sell our mailing list, nor do we disclose private information to any other person or company, except as outlined in this policy.

- Opt-Out: Should you prefer not to be contacted, please let us know, and we will ensure your name is withheld. All marketing emails will contain an unsubscribe link to remove yourself from the mailing list.

Namecheck may disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to:
- Conform to the edicts of the law or comply with legal process served on Namecheck.
- Protect and defend the rights or property of Namecheck.
- Act in urgent circumstances to protect the personal safety of users, our websites, or the public.
2. Security Measures
Namecheck strictly protects the security of your personal information and honors your choices for its intended use. We carefully protect your data from loss, misuse, unauthorized access, disclosure, alteration, or destruction.
- Internal Security: Inside the company, data is stored on password-controlled servers with limited access.
- Encryption: All sensitive information is encrypted to ensure privacy.
- Compliance: Namecheck has adopted additional cybersecurity measures through the Merchant Trust Initiative. We meet PCI DSS requirements and joined this compliance program developed by payment card industry leader, Trustwave, in December 2018.
- User Responsibility: You have a significant role in protecting your information. No one can see or edit your personal information without knowing your login and password; do not share these credentials with others.
3. Public Information & Reference Accuracy
Namecheck provides public information for use by landlords, employers, and their representatives via our website.
Source Integrity
- We do not alter or amend information made available from the original source (e.g., Ministry of Justice).
- While we make every reasonable effort to ensure high accuracy when recording names, we and the Tribunal rely on the party initiating proceedings to accurately identify the parties.
- Historical Data: Namecheck has chosen not to display the full details of court orders dated between 2008 and May 2012. Only the history of names, dates, and locations is listed. This alerts landlords to older orders while protecting tenants who have had positive outcomes since.
References
- References from other users/members reflect their own views and not those of Namecheck.
- Vetting: We endeavor to authenticate that those listing references are who they claim to be before placing their information. This process takes time, but reference listings go live promptly for verified regular users.
- Standards: Namecheck will not post references that do not meet our standards of authenticity, accuracy, and language.
- Disputes: We will consider any reported breach of accuracy when informed.
4. Credit Reporting & Driver License Checks
Our services include third-party checks which are strictly regulated by the Credit Reporting Privacy Code 2020 and the Privacy Act 2020.
Permitted Use
Namecheck Credit and License Checks are for:
- Landlords offering a prospective tenancy.
- Employers offering a prospective job involving significant financial risk.
Collection & Disclosure Process
In these limited circumstances, the Landlord or Employer (or their agent) must:
- Make clear to the applicant that providing a Driver License (or Passport/Gun License) is voluntary.
- Obtain the applicant’s consent and use the Namecheck Authorization Form.
- Take reasonable steps to verify that the applicant is the individual shown on the ID (Driver License, Passport, Gun License, or Gold Card photo).
- Disclose this information via Namecheck to the credit reporter (Centrix) or the New Zealand Transport Agency (NZTA).
Verification Results
- License Check: Verifies if a license is valid, not lost/stolen, and is the most recent version.
- Data Masking: A credit reporter may confirm validity by disclosing the driver license number back to you in a masked form (replacing the last two digits with special characters).
- Disputes: Centrix has its own complaints procedure and specialists to help resolve complaints in a fair, simple, and efficient manner.

6. General Disclaimers & Definitions
Employment Advice
Any employment advice provided by Namecheck comes from three Employment Law Advocates who are members of the Employment Law Institute Inc. This is generic New Zealand information and is not a substitute for legal advice specific to your business.
Definition of “Working Day”
For the purposes of our services, a “Working Day” means any day of the week other than:
- Saturday, Sunday, Good Friday, Easter Monday, Anzac Day, the Sovereign’s Birthday, Waitangi Day, and Matariki.
- A day in the period commencing with 24th December in any year and ending with 16th January in the following year.
